Terms of Service
These Terms of Service explain the rules for using peakandvale.co and the terms on which Peak & Vale supplies products to customers. Please read them before using the website, joining a waitlist, using an access code or placing an order.
1. About us
This website is operated by PEAK & VALE CO. LTD (referred to as “Peak & Vale”, “we”, “us” or “our”).
We are a private limited company registered in England and Wales under company number 16950966. Our registered office is:
86–90 Paul Street, London, Greater London, England EC2A 4NE
You can contact us at candice@peakandvale.co.
If we need to contact you, we will normally do so using the email address or other contact details supplied with your account, access request or order.
2. These terms
By using our website, you agree to the website-use provisions in these Terms. If you place an order, the sales provisions also form part of the contract between you and Peak & Vale.
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order. You confirm that the information you provide is accurate, current and complete.
If you do not agree to these Terms, you should not use the website or place an order.
Nothing in these Terms affects any legal rights that cannot lawfully be limited or excluded.
3. Website availability
We aim to keep the website accurate, secure and available, but we do not guarantee that it will always be uninterrupted or free from errors. We may suspend, withdraw or change all or part of the website for maintenance, security, operational or business reasons.
Product information, editorial content, field-test information and expected launch dates are provided in good faith. Unless they form part of a confirmed order, they are not a binding promise that a product or feature will be released by a particular date.
We may update these Terms from time to time. The version displayed when you place an order will apply to that order. Changes will not retrospectively reduce your rights under an existing contract.
4. Accounts and access
Some products, releases, events or areas of the website may be limited to approved customers, waitlist members, field testers or people with a valid access code.
An invitation, waitlist position or access code:
gives an opportunity to access the relevant release or experience, subject to availability;
does not reserve stock or guarantee that an order will be accepted;
has no cash value and may not be sold, auctioned or exchanged for payment;
may be personal, limited by time or limited in the number of uses stated when issued; and
may be withdrawn if it was obtained, shared or used fraudulently, unlawfully or contrary to these Terms.
You are responsible for keeping account credentials and non-public access codes secure. Please tell us promptly if you believe an account or code has been compromised.
We may limit purchases per person, household, address, payment method or access code where reasonably necessary to allocate limited stock fairly or prevent misuse.
5. Waitlists and messages
Joining a waitlist or requesting access does not require you to buy anything and does not create a sales contract.
We may use the contact details supplied to administer your request, notify you about access and provide essential information connected with a release. Marketing messages will be handled in accordance with our Privacy Policy and applicable law. You can unsubscribe from marketing at any time, although you may still receive service messages about an active request or order.
6. Products and descriptions
We take reasonable care to describe and display products accurately. Images are illustrative, and colours can appear differently depending on lighting, photography and screen settings.
Because textiles and natural materials can vary, minor differences in colour, grain, texture, weight or finish may occur between batches or individual garments. These natural or manufacturing variations are not defects where they fall within reasonable tolerances and do not affect the product’s quality, performance or conformity with its description.
Measurements and fit guidance are approximate unless expressly stated otherwise. Please review the applicable size guide before ordering. No website description limits your rights if a product is faulty, not as described or otherwise fails to meet applicable legal standards.
Product names, specifications, materials and construction may change before an order is accepted. After a contract is formed, we will not make a material change to the ordered product without informing you. If a proposed change is more than minor, you may reject it and receive a refund for the affected product.
7. Orders and acceptance
The steps required to place an order will be shown at checkout. You are responsible for checking the product, size, colour, quantity, delivery address and total price before submitting the order.
Placing an order is an offer to buy the selected products. An automated acknowledgement confirms receipt of the order but does not necessarily mean that we have accepted it.
A contract is formed when we send an order-confirmation email expressly accepting the order. If we cannot accept the order, we will tell you and refund any payment taken for it.
We may decline or cancel an order before dispatch where, for example:
the product is unavailable;
payment cannot be authorised;
the price or product information contained an obvious error that you knew or reasonably should have known was an error;
we cannot deliver to the supplied address;
purchase limits have been exceeded; or
we reasonably suspect fraud, misuse or unlawful activity.
If only part of an order is unavailable, we may accept and fulfil the remaining items after notifying you. You may cancel the remaining order if the unavailable item formed an essential part of the purchase.
8. Pre-orders and deposits
A product described as a “pre-order”, “made for release” or similar is not ready for immediate dispatch. The product page and order confirmation will give an estimated dispatch date or delivery window. By ordering, you agree that this stated timing replaces the standard delivery timing that would otherwise apply.
Pre-order dates are estimates because development, material supply, manufacturing, quality control, customs and freight can affect timing. We will provide a material update if the expected timing changes significantly.
Unless the product page clearly states otherwise:
payment is taken when the pre-order is placed;
you may cancel before dispatch for a full refund; and
if we cannot supply the product, we will cancel the affected order and refund all sums paid for it.
If we offer a deposit rather than full prepayment, the product page and checkout will state the deposit amount, whether it is refundable, when the balance becomes payable and what happens if the balance is not paid. Any deposit condition displayed at checkout forms part of these Terms. A deposit will not be described as non-refundable where retaining it would be unlawful or unfair.
If a pre-order delay is substantial, we will offer a revised estimate and a reasonable opportunity to continue with or cancel the affected order for a full refund.
9. Prices, taxes and duties
Prices are displayed in the currency shown on the website and include UK VAT where applicable, unless clearly stated otherwise. Delivery charges and any other mandatory charges payable to us will be shown before you place the order.
For deliveries outside the United Kingdom, import duties, local taxes, customs charges and carrier handling fees may apply. Checkout will state whether those charges are:
included and collected when you order; or
excluded and payable by the recipient on import.
Where charges are excluded, you are responsible for paying them. Customs requirements vary by destination, and you are responsible for providing any information reasonably required for import clearance. We will not intentionally under-declare a parcel’s value or mark a commercial order as a gift.
If a pricing error is obvious and could reasonably have been recognised as an error, we may cancel the affected order before dispatch and refund the amount paid. Otherwise, the confirmed price will apply.
10. Payment
We accept the payment methods displayed at checkout. By submitting payment details, you confirm that you are authorised to use the selected payment method.
Payments may be processed by third-party payment providers. Their separate terms and privacy practices may apply to the processing service, but Peak & Vale remains responsible for its obligations under the sales contract.
You must pay all amounts due at checkout unless a deposit or later-payment arrangement is clearly offered and accepted. We do not store complete card details where payment is handled directly by a payment provider.
11. Delivery
Available destinations, delivery methods, charges and estimates will be shown at checkout or on the relevant product page.
We will deliver to the address stated in the order. Please check it carefully and contact us promptly if a correction is needed. We cannot guarantee that an address can be changed after dispatch.
Delivery dates are estimates unless we expressly agree that a particular date is essential. For in-stock products, we will deliver without undue delay and, unless a different period has been agreed, no later than 30 days after the contract is formed.
For pre-orders, the delivery window stated on the product page or order confirmation is the agreed delivery arrangement. If we miss an essential deadline, refuse to deliver, or fail to deliver within an appropriate additional period you give us, you may have the right to end the contract and receive a refund.
An order may arrive in more than one parcel. You will not be charged additional delivery fees unless they were disclosed and accepted before the order was placed.
12. Risk and ownership
We remain responsible for products until they are delivered into your physical possession or that of a person you identified to receive them. If you appoint a carrier that we did not offer, risk may pass when the product is handed to that carrier.
Ownership passes to you when we have received payment in full and the product has been delivered, unless applicable law provides otherwise.
If a parcel appears lost, damaged or misdelivered, contact us promptly so that we can investigate with the carrier. Your legal rights are not affected by a carrier’s investigation process.
13. Cancelling an online order
If you are a consumer in the United Kingdom, you normally have the right to cancel an online purchase without giving a reason from the date the contract is formed until 14 days after the day on which you, or a person nominated by you other than the carrier, receives the product.
For multiple products delivered separately under one order, the cancellation period normally ends 14 days after the day the last product is received.
To cancel, send a clear statement to candice@peakandvale.co before the cancellation period expires. You may use the model cancellation form at the end of these Terms, but you do not have to.
The statutory cancellation right may not apply to products that are made to your specifications or clearly personalised, or in another circumstance where the law provides an exception. Choosing a standard size or colour from our normal options does not by itself make a product personalised.
Customers outside the United Kingdom may have equivalent or additional rights under mandatory local law.
14. Returns
After telling us that you are cancelling, you must send the product back without undue delay and no later than 14 days after the day you notified us. Contact us before sending a return so that we can provide the correct returns address and instructions.
Unless the product is faulty, not as described, incorrect, damaged on arrival, or we agree otherwise, you are responsible for the direct cost of returning it. We recommend using a tracked service and retaining proof of postage.
You may inspect a product as you reasonably would in a shop. We may reduce a refund to reflect a loss in value caused by handling beyond what is reasonably necessary to establish the product’s nature, characteristics and fit. Please return products clean, with their original components and, where reasonably possible, their tags and packaging.
Any voluntary returns period offered in a separate Returns Policy is additional to your legal rights. If that policy is more generous than these Terms, the more generous provision will apply.
15. Refunds
When you validly cancel an entire order, we will refund the price paid and the cost of our least expensive standard delivery option. We do not have to refund the extra cost of an enhanced delivery method that you selected.
We will issue the refund without undue delay and no later than 14 days after the earliest of:
the day we receive the returned product;
the day you provide evidence that it was sent back; or
for an order where no product was supplied, 14 days after you tell us that you are cancelling.
Refunds will normally be made to the original payment method. We may withhold a goods refund until we receive the product or evidence that it has been returned, unless we offered to collect it.
Banks and payment providers may take additional time to show a completed refund in an account. This processing time is outside our control.
16. Faulty or incorrect products
We are responsible for supplying products that are as described, of satisfactory quality, fit for their usual purpose and compliant with applicable law.
If a product is faulty, damaged, misdescribed or incorrect, contact candice@peakandvale.co with the order number and a description of the issue. Photographs may help us assess the problem, but we will not make a legal remedy conditional on photographs where that would be unreasonable.
Depending on the circumstances and applicable law, you may be entitled to reject the product, receive a repair or replacement, receive a price reduction or obtain a refund. Where the product does not conform to the contract, we will bear reasonable return costs.
Fair wear and tear, accidental damage, misuse, failure to follow reasonable care instructions, or changes caused by normal laundering or ageing are not manufacturing faults. This does not exclude a claim where the product lacked the durability a reasonable customer was entitled to expect.
17. Promotions and benefits
Promotion codes, member benefits, early-access rights and invitations are subject to any specific conditions communicated with them. Unless stated otherwise, they:
cannot be exchanged for cash;
cannot be applied retrospectively;
cannot be combined with another offer;
apply only during the stated period and while relevant stock remains available; and
may be limited by customer, order, product, territory or number of uses.
We may correct, suspend or withdraw a promotion where there is an error, fraud, misuse or a legal or technical requirement to do so. We will not remove a benefit already validly applied to an accepted order unless continuing it would be unlawful or the customer agrees.
A statement that a benefit is “lifetime” means for as long as Peak & Vale continues to operate the relevant programme or service. It does not guarantee that the company, website, programme, product category or benefit will exist indefinitely. If a lifetime benefit is a material part of a paid offer, we will not remove it arbitrarily and will provide a fair remedy where required by law.
18. Reviews and user content
If you submit a review, image, comment, field-test report, suggestion or other content, you confirm that it is based on your genuine experience, is accurate to the best of your knowledge, and does not infringe another person’s rights or contain unlawful, abusive or misleading material.
You retain ownership of your content. You grant Peak & Vale a non-exclusive, worldwide, royalty-free licence to host, reproduce, edit for length or formatting, and display it for operating and promoting Peak & Vale and its products. We will not materially change the meaning of a review or present an incentivised review as independent.
If a review or other content was incentivised, gifted or created through a field-test programme, you must disclose that clearly. We may label, decline or remove content where reasonably necessary to comply with law, protect others or maintain the integrity of the website.
19. Intellectual property
The website and its contents—including text, photography, graphics, designs, product names, logos, videos, software and trade marks—are owned by or licensed to Peak & Vale and are protected by intellectual-property laws.
You may view and use the website for personal, non-commercial purposes. You may not copy, reproduce, modify, scrape, distribute, sell, exploit or create derivative works from any part of the website without prior written permission, except where applicable law expressly allows it.
“Peak & Vale”, associated logos, collection names and product identifiers may be trade marks or other protected brand assets. No right to use them is granted except as expressly stated in these Terms.
20. Acceptable use
You must not:
use the website for unlawful, fraudulent or abusive purposes;
attempt to gain unauthorised access to the website, accounts, codes, servers or connected systems;
introduce viruses, malicious code or other harmful material;
interfere with the website’s operation or security;
use automated systems to extract data, reserve inventory or purchase products without permission;
impersonate another person or provide false information;
evade purchase limits or access controls; or
infringe our rights or the rights of another person.
We may restrict or suspend access where we reasonably believe this section has been breached. Where an accepted order is affected, we will act fairly and will not remove mandatory consumer rights.
21. Third-party services
The website may link to third-party websites or use third-party services, such as payment, delivery, mapping, social-media or authentication tools. A link does not mean that we endorse or control the third party.
Third-party services may have their own terms and privacy notices. We are not responsible for a third-party website that is outside our control, but this does not reduce our responsibility for our own obligations, including the fulfilment of an order placed with Peak & Vale.
22. Privacy and cookies
Our Privacy Policy explains how we collect, use, share and protect personal data. Our Cookie Policy explains how cookies and similar technologies are used. Those policies should be read alongside these Terms.
Where consent is required for non-essential cookies or direct marketing, it will be requested separately. Accepting these Terms does not itself constitute consent to optional cookies or marketing.
23. Our responsibility
We do not exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and liability for breaching rights that the law does not allow us to exclude.
If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of that failure or of our failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was formed.
Products sold to consumers are supplied for personal and domestic use. We are not responsible for business losses, including loss of profit, revenue, opportunity, anticipated savings or business interruption, arising from consumer use of a product or the website.
We are not responsible for delay or failure caused by an event outside our reasonable control, but we will take reasonable steps to reduce the effect of the event. If it materially delays an order, we will provide an update and any cancellation or refund right required by law.
24. Your responsibility
You are responsible for following product-care instructions, using products safely and appropriately, and checking whether a product is suitable for any specific activity or environment.
Performance descriptions relate to the conditions and testing stated on the relevant product page. No garment can eliminate all risk from weather, terrain, travel or outdoor activity. You remain responsible for appropriate preparation, judgement and equipment.
This section does not reduce our responsibility if a product is unsafe, faulty, misdescribed or otherwise fails to conform to the contract.
25. Ending website access
You may stop using the website at any time. We may suspend or terminate an account or website access where reasonably necessary because of misuse, security concerns or a material breach of these Terms.
Ending website access does not automatically cancel an accepted order. Any order must be cancelled in accordance with the applicable cancellation provisions.
Provisions that are intended to continue—including those dealing with intellectual property, liability, governing law and existing payment or refund obligations—will survive termination.
26. General provisions
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue in effect. The affected provision will be treated as modified only to the minimum extent necessary to make it valid and enforceable.
A delay in enforcing a right does not waive that right. A waiver on one occasion does not constitute a waiver on another occasion.
The contract is between you and Peak & Vale. No other person has a right to enforce it, except where applicable law expressly provides otherwise.
We may transfer our rights and obligations to another organisation, but only where this does not reduce your rights. You may transfer your rights where the law permits or where we agree in writing.
27. Governing law
These Terms and contracts made under them are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom or another country, you retain the benefit of any mandatory protections given by the law of your country of residence. Nothing in these Terms deprives you of those protections.
You may bring proceedings in the courts of England and Wales. If you live in Scotland, Northern Ireland or another jurisdiction whose mandatory law gives you the right to bring proceedings locally, you may also bring proceedings in the courts available to you under that law.
28. Complaints
If something has gone wrong, contact candice@peakandvale.co with your name, order number and a clear description of the issue. We will acknowledge the complaint and aim to resolve it fairly within a reasonable period.
